Bor\u00e7lar kanunumuzda kira s\u00f6zle\u015fmesi ayr\u0131nt\u0131l\u0131 olarak d\u00fczenlenmi\u015ftir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Yeni Bor\u00e7lar Kanunumuza g\u00f6re Kira s\u00f6zle\u015fmesi, kiraya verenin bir \u015feyin kullan\u0131lmas\u0131n\u0131 veya kullanmayla birlikte ondan yararlan\u0131lmas\u0131n\u0131 kirac\u0131ya b\u0131rakmay\u0131, kirac\u0131n\u0131n da buna kar\u015f\u0131l\u0131k kararla\u015ft\u0131r\u0131lan kira bedelini \u00f6demeyi \u00fcstlendi\u011fi s\u00f6zle\u015fmedir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Kanunumuz ge\u00e7erli bir kira s\u00f6zle\u015fmesinden bahsedebilmek \u0130\u00e7in s\u00f6zle\u015fmenin mutlaka yaz\u0131l\u0131 olmas\u0131n\u0131 \u015fart ko\u015fmam\u0131\u015ft\u0131r. Ticari hayatta s\u00f6zle\u015fme serbestli\u011fi ilkesi gere\u011fince kira s\u00f6zle\u015fmesinin yaz\u0131l\u0131 olmas\u0131 \u015fart de\u011fildir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Yaz\u0131l\u0131 kira s\u00f6zle\u015fmesi yoksa fiilen kiraya veren ile kirac\u0131 aras\u0131nda bir ili\u015fki ba\u015flam\u0131\u015fsa kira akti var oldu\u011fu kabul edilir; ancak kira s\u00f6zle\u015fmesinin yaz\u0131l\u0131 olmas\u0131n\u0131n bir\u00e7ok faydas\u0131 vard\u0131r.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>\u00d6zellikle kira s\u00f6zle\u015fmesinin varl\u0131\u011f\u0131n\u0131 kan\u0131tlamak ve ileride ispat kolayl\u0131\u011f\u0131 sa\u011flamak i\u00e7in kira s\u00f6zle\u015fmesinin yaz\u0131l\u0131 olmas\u0131 gerekmektedir. Kira s\u00f6zle\u015fmesinin s\u00fcresi, bedeli ve taraflar\u0131n belirledi\u011fi \u00f6zel \u015fartlar yaln\u0131zca yaz\u0131l\u0131 bir s\u00f6zle\u015fme ile ortaya konulabilir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kira s\u00f6zle\u015fmesi, belirli ve belirli olmayan bir s\u00fcre i\u00e7in yap\u0131labilir. \u00d6zellikle kira kontratlar\u0131 belirli s\u00fcreli yap\u0131lmaktad\u0131r. Kiraya veren, kira konusu e\u015fyay\u0131 kullan\u0131ma haz\u0131r bulundurmakla y\u00fck\u00fcml\u00fc; kirac\u0131 ise e\u015fyan\u0131n kullan\u0131m\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda bedel \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc alt\u0131ndad\u0131r.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\n<p>Konut ve i\u015f yerleri a\u00e7\u0131s\u0131ndan kirac\u0131n\u0131n hangi periyotlarla kira bedelini \u00f6deyece\u011fi ve hangi vas\u0131ta (elden veya banka) ile \u00f6deme<\/p>\n<div dir=\"auto\" data-olk-copy-source=\"MessageBody\">yap\u0131laca\u011f\u0131 hususlar\u0131nda kira kontrat\u0131nda ayr\u0131nt\u0131\u0131 d\u00fczenlenmesi bir\u00e7ok sorunu \u00f6nlemek bak\u0131m\u0131ndan \u00f6nemlidir.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Kira kontratlar\u0131nda \u00f6deme g\u00fcn\u00fc taraflarca a\u00e7\u0131k olarak belirtilmelidir. Aksi halde kirac\u0131, s\u00f6zle\u015fme ve yerel \u00e4det olmad\u0131k\u00e7a, kira bedelini ve gerekiyorsa yan giderleri, her ay\u0131n sonunda ve en ge\u00e7 kira s\u00fcresinin bitiminde \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kira s\u00f6zle\u015fmesinde \u00f6deme g\u00fcn\u00fc kararla\u015ft\u0131r\u0131lmad\u0131ysa kanun h\u00fckm\u00fc gere\u011fince \u00f6deme ay\u0131n son g\u00fcn\u00fc yap\u0131lacakt\u0131r. \u00d6rnek vermek gerekirse; \u00ab\u00a0kira bedeli her ay\u0131n \u00fc\u00e7\u00fcn\u00fcn ak\u015fam\u0131na kadar ilgili bankan\u0131n hesab\u0131na kiraya veren ad\u0131na pe\u015fin olarak yat\u0131r\u0131lacakt\u0131r.\u00a0\u00bb h\u00fckm\u00fc konulmas\u0131 kira kontrat\u0131nda ge\u00e7erli bir ifadedir.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Kira s\u00f6zle\u015fmesinde olmas\u0131 gereken \u00f6nemli kay\u0131tlar\u0131 bu yaz\u0131m\u0131zda anlataca\u011f\u0131z.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>1.MUACCEL\u0130YET \u015eARTI<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Yeni bor\u00e7lar kanunumuzda muacceliyet yasa\u011f\u0131 getirilmi\u015ftir. Bu yasal d\u00fczenlemenin kamu d\u00fczenine ili\u015fkin oldu\u011fu ku\u015fkusuzdur. Muacceliyet; \u00d6zellikle kira s\u00f6zle\u015fmelerinde s\u0131kl\u0131kla g\u00f6r\u00fclen bir kay\u0131tt\u0131r. Kira bedellerinden herhangi biri zaman\u0131nda \u00f6denmezse d\u00f6nem sonuna kadarki t\u00fcm kira bedelleri muaccel olur. Muaccel olur demek istenilebilir hale gelmek demektir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>6098 S.K.&rsquo;da; Kirac\u0131ya kira bedeli ve yan giderler d\u0131\u015f\u0131nda ba\u015fka bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilemeyece\u011fi, \u00f6zellikle kira bedelinin zaman\u0131nda \u00f6denmemesi halinde ceza ko\u015fulu \u00f6denece\u011fine veya sonraki kira bedellerinin muaccel olaca\u011f\u0131na ili\u015fkin anla\u015fmalar\u0131n ge\u00e7ersiz oldu\u011fu d\u00fczenlenmi\u015ftir. Taraflar aras\u0131nda kira s\u00f6zle\u015fmesinde muacceliyet kayd\u0131 koyulsa bile ge\u00e7erli olmayaca\u011f\u0131 kabul edilmi\u015ftir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>2.FA\u0130Z \u015eARTI<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Kira s\u00f6zle\u015fmesinde, kira bedelinin zaman\u0131nda \u00f6denmemesi durumunda kiraya verenin faiz isteyebilmesi kabul edilmektedir.<\/strong><\/div>\n<div dir=\"auto\">\n<div dir=\"auto\" data-olk-copy-source=\"MessageBody\"><strong>T\u00fcrk Bor\u00e7lar Kanunu&rsquo;nun 120. maddesi gere\u011fince, uygulanacak y\u0131ll\u0131k temerr\u00fct faiz oran\u0131 s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lmam\u0131\u015fsa, faiz borcunun do\u011fdu\u011fu tarihte y\u00fcr\u00fcrl\u00fckte bulunan mevzuat h\u00fck\u00fcmlerine g\u00f6re belirlenir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>S\u00f6zle\u015fme ile kararla\u015ft\u0131r\u0131lacak y\u0131ll\u0131k faiz oran\u0131 birinci f\u0131kra uyar\u0131nca belirlenen y\u0131ll\u0131k faiz oran\u0131n\u0131n y\u00fczde y\u00fcz fazlas\u0131n\u0131 a\u015famaz.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u015e\u00f6yle ki; temerr\u00fct halinde i\u015fleyecek faiz oran\u0131 s\u00f6zle\u015fmede belirlenebilir ancak bu rakam kanuna g\u00f6re belirli s\u0131n\u0131rlar aras\u0131nda olmal\u0131d\u0131r. Temerr\u00fct faiz oran\u0131, faiz kanunda ifade edilmi\u015ftir. Bu miktar ticari olmayan i\u015flerde y\u0131ll\u0131k y\u00fczde 9; ticari i\u015flerde merkez bankas\u0131n\u0131n avans faiz oran\u0131na at\u0131f yap\u0131lm\u0131\u015ft\u0131r bu oran y\u0131ll\u0131k y\u00fczde 11&rsquo;dir.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kira s\u00f6zle\u015fmesinde faiz \u015fart\u0131 a\u00e7\u0131k\u00e7a belirlenmemi\u015fse kanun gere\u011fi i\u015fletilecek faiz oran\u0131 y\u00fcr\u00fcrl\u00fckteki mevzuat faiz oran\u0131n\u0131n y\u00fczde y\u00fcz\u00fcn\u00fc ge\u00e7emez dedi\u011fi i\u00e7in ticari i\u015flerde y\u0131ll\u0131k en fazla y\u00fczde yirmi iki; ticari olmayan i\u015flerde ise en fazla y\u0131ll\u0131k y\u00fczde on sekizi a\u015fmayacak \u015fekilde faiz oran\u0131 belirlenecektir.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>3.CEZA\u0130 \u015eART<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kira s\u00f6zle\u015fmelerinde kirac\u0131 ve kiraya veren, s\u00f6zle\u015fmeyi erken feshetmeyi kararla\u015ft\u0131rabilir. Kira s\u00f6zle\u015fmelerinin erken feshedilmesi durumunda taraflar\u0131n kira s\u00f6zle\u015fmesinden do\u011fan y\u00fck\u00fcml\u00fcl\u00fcklerini ifa etmekten ka\u00e7\u0131r\u0131malar\u0131n\u0131 engellemek i\u00e7in s\u00f6zle\u015fmede bir cezai \u015fart kararla\u015ft\u0131r\u0131labilir.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Kirac\u0131ya, kira bedeli ve yan giderler d\u0131\u015f\u0131nda ba\u015fka bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilemez. \u00d6zellikle, kira bedelinin zaman\u0131nda \u00f6denmemesi halinde ceza ko\u015fulu \u00f6denece\u011fine veya sonraki kira bedellerinin muaccel olaca\u011f\u0131na ili\u015fkin anla\u015fmalar ge\u00e7ersizdir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><strong>Bunun yan\u0131nda kira bedelinin zaman\u0131nda \u00f6denmemesi halinde ayr\u0131ca cezai \u015fart \u00f6denece\u011fine ili\u015fkin bir h\u00fck\u00fcm varsa s\u00f6zle\u015fmede bu kay\u0131t ge\u00e7erli de\u011fildir.<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\n<div dir=\"auto\" data-olk-copy-source=\"MessageBody\"><strong>4.K\u0130RA BEDEL\u0130 ARTI\u015e ORANI<\/strong><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kira s\u00f6zle\u015fmelerinde kira art\u0131\u015f\u0131n ne oranda yap\u0131laca\u011f\u0131 hususu kira kontrat\u0131n\u0131n olmazsa olmaz\u0131d\u0131r. Kira s\u00f6zle\u015fmelerinde kira bedelinin belirlenmesi d\u0131\u015f\u0131nda, kirac\u0131 aleyhine de\u011fi\u015fiklik yap\u0131lamaz. Kira art\u0131\u015f\u0131 i\u00e7in kira s\u00f6zle\u015fmesine \u00f6zel bir h\u00fck\u00fcm konulmam\u0131\u015fsa kira art\u0131\u015f\u0131n\u0131n nas\u0131l yap\u0131laca\u011f\u0131 kanunda d\u00fczenlenmi\u015ftir.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u00ab\u00a0Kirac\u0131, kira bedelini \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. A\u00e7\u0131k veya \u00f6rt\u00fcl\u00fc bi\u00e7imde bir s\u00fcre belirlenmi\u015fse, kira s\u00f6zle\u015fmesi bu s\u00fcrenin sonunda kendili\u011finden sona erer.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Taraflar, bu durumda, a\u00e7\u0131k bir anla\u015fma olmaks\u0131z\u0131n kira ili\u015fkisini s\u00fcrd\u00fcr\u00fcrlerse, kira s\u00f6zle\u015fmesi belirsiz s\u00fcreli s\u00f6zle\u015fmeye d\u00f6n\u00fc\u015f\u00fcr.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir.
