Son d\u00f6nemde de konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131ndaki art\u0131\u015f g\u00fcndemden d\u00fc\u015fmemektedir. Pahal\u0131la\u015fan hayat \u015fartlar\u0131 nedeniyle kiraya verenin kira bedelinde art\u0131\u015fa gitme iste\u011fi makul g\u00f6r\u00fclmelidir. Ancak kira bedelinde yap\u0131lacak art\u0131\u015f miktar\u0131, tamamen kiraya verenin inisiyatifine de b\u0131rak\u0131lmam\u0131\u015ft\u0131r. Bu hususa ili\u015fkin hukuki s\u0131n\u0131rlamalar mevcuttur. A\u015fa\u011f\u0131da konut ve \u00e7at\u0131l\u0131 i\u015f yeri kira art\u0131\u015flar\u0131na ili\u015fkin temel hukuki bilgileri sizlerle payla\u015faca\u011f\u0131z. Her hukuki problemin somut olay\u0131n \u00f6zelliklerine g\u00f6re de\u011ferlendirilmesi gerekti\u011fini de \u00f6nemle belirtmek isteriz.<\/p>\n<p>T\u00fcrk Bor\u00e7lar Kanunu Madde 346 \u00ab\u00a0Kirac\u0131ya, kira bedeli ve yan giderler d\u0131\u015f\u0131nda ba\u015fka bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilemez. \u00d6zellikle, kira bedelinin zaman\u0131nda \u00f6denmemesi h\u00e2linde ceza ko\u015fulu \u00f6denece\u011fine veya sonraki kira bedellerinin muaccel olaca\u011f\u0131na ili\u015fkin anla\u015fmalar ge\u00e7ersizdir.\u00a0\u00bb \u015feklindedir. Kanun koyucu, kira s\u00f6zle\u015fmesi kurulduktan sonra kirac\u0131 aleyhine de\u011fi\u015fiklik yapma yasa\u011f\u0131 getirerek kirac\u0131y\u0131 korumay\u0131 ama\u00e7lam\u0131\u015ft\u0131r. Bunun istisnalar\u0131ndan biri kanun maddesinde de a\u00e7\u0131k\u00e7a yer ald\u0131\u011f\u0131 \u00fczere kira bedelidir.<\/p>\n<p>Yenilenen kira d\u00f6nemlerinde kira miktar\u0131n\u0131n art\u0131\u015f\u0131, taraflar aras\u0131nda kira art\u0131\u015f\u0131na ili\u015fkin anla\u015fma olup olmamas\u0131na g\u00f6re ayr\u0131 ayr\u0131 de\u011ferlendirilmelidir. Taraflar aras\u0131nda kira art\u0131\u015f oran\u0131n\u0131n ne olaca\u011f\u0131 y\u00f6n\u00fcnde anla\u015fma var ise bu anla\u015fma uyar\u0131nca kira art\u0131\u015f\u0131 ger\u00e7ekle\u015fecektir. Ancak taraflar aras\u0131nda bu husustaki anla\u015fman\u0131n ge\u00e7erli olmas\u0131 i\u00e7in belirlenen kira art\u0131\u015f oran\u0131n\u0131n, \u00f6nceki kira y\u0131l\u0131nda T\u00fcketici Fiyat Endeksi\u2019ndeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memesi gerekmektedir.<\/p>\n<p>Taraflar aras\u0131nda anla\u015fma olmamas\u0131 halinde ise yine \u00f6l\u00e7\u00fct\u00fcm\u00fcz bir \u00f6nceki kira y\u0131l\u0131n\u0131n T\u00dcFE\u2019deki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131 olacakt\u0131r. Bir ba\u015fka deyi\u015fle kira art\u0131\u015f oran\u0131na ili\u015fkin s\u00f6zle\u015fmede bir h\u00fck\u00fcm yoksa ya da s\u00f6zle\u015fme yap\u0131lmam\u0131\u015fsa kira art\u0131\u015f oran\u0131 T\u00dcFE&rsquo;ye g\u00f6re belirlenecektir.<\/p>\n<p>Peki T\u00dcFE nedir?<\/p>\n<p>T\u00dcFE yani T\u00fcketici Fiyat Endeksi, hane halklar\u0131n\u0131n t\u00fcketimine y\u00f6nelik mal ve hizmet fiyatlar\u0131n\u0131n zaman i\u00e7indeki de\u011fi\u015fimini \u00f6l\u00e7erek enflasyon oran\u0131n\u0131 hesaplamakt\u0131r. T\u00fcketici Fiyat Endeks sonu\u00e7lar\u0131 her ay\u0131n \u00fc\u00e7\u00fcnde saat 10:00\u2019 da T\u00fcrkiye \u0130statistik Kurumu taraf\u0131ndan a\u00e7\u0131klan\u0131r. Bu verilere g\u00f6re yasal kira art\u0131\u015f oran\u0131 belirlenir.<\/p>\n<p>Somut \u00f6rnek ile a\u00e7\u0131klamak gerekirse: Kira zamm\u0131 2021 y\u0131l\u0131n\u0131n ekim ay\u0131nda yap\u0131lacak ise T\u00dc\u0130K&rsquo;in eyl\u00fcl 2021 T\u00dcFE verisi dikkate al\u0131nmal\u0131d\u0131r. Bu veriye g\u00f6re 2021 Y\u0131l\u0131n\u0131n ekim ay\u0131 i\u00e7in yasal kira art\u0131\u015f oran\u0131 %16,42\u2019 dir. Yani kira zamm\u0131 \u00f6ncesinde ayl\u0131k 1.500 TL kira veriyorsan\u0131z, ekim 2021 itibariyle kiran\u0131z en fazla 246,3 TL tutar\u0131nda artabilir.<\/p>\n<p>E\u011fer ki kiraya veren ile aran\u0131zda bir s\u00f6zle\u015fme mevcut ise bu durumda s\u00f6zle\u015fmede yer alan art\u0131\u015f oran\u0131 uygulanacakt\u0131r. \u00d6rne\u011fin; Kira s\u00f6zle\u015fmenizde kira art\u0131\u015f oran\u0131 %12 belirlenmi\u015fse o y\u0131l\u0131n T\u00dcFE\u2019si %16,42 ise bu durumda o y\u0131lki kira %12\u2019lik art\u0131\u015fa g\u00f6re yap\u0131lacakt\u0131r. T\u00dcFE %12\u2019den d\u00fc\u015f\u00fck \u00e7\u0131karsa bu seferde kira art\u0131\u015f oran\u0131 T\u00dcFE\u2019yi ge\u00e7emeyece\u011fi i\u00e7in kiraya T\u00dcFE oran\u0131 uygulanacakt\u0131r. S\u00f6zle\u015fmede T\u00fcfe+ \u00dcfe(2) gibi ibareler ise ge\u00e7ersiz olup bu ibarelere itibar edilmemelidir.<\/p>\n<p>&nbsp;<\/p>\n<p>Uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde kira art\u0131\u015f miktar\u0131 nas\u0131l belirlenir?<\/p>\n<p>Kanun koyucu, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerine ili\u015fkin T\u00fcrk Bor\u00e7lar Kanunu&rsquo;nun 344. Maddesinin 3. F\u0131kras\u0131nda ayr\u0131ca d\u00fczenleme yapm\u0131\u015ft\u0131r. Burada yap\u0131lan d\u00fczenlemeye g\u00f6re taraflar aras\u0131nda s\u00f6zle\u015fme olup olmamas\u0131n\u0131n bir \u00f6nemi yoktur. \u0130lgili d\u00fczenleme uyar\u0131nca s\u00fcresi 5 y\u0131ldan uzun s\u00fcreli veya 5 y\u0131ldan sonra yenilenmeye devam eden kira s\u00f6zle\u015fmelerinde ve bunlar\u0131n ard\u0131ndan her 5 y\u0131l\u0131n sonunda yeni d\u00f6nemde uygulanacak olan kira bedeli, h\u00e2kim taraf\u0131ndan T\u00dcFE\u2019deki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenecektir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere 5 y\u0131ll\u0131k ve 5 y\u0131ldan uzun s\u00fcreli s\u00f6zle\u015fmelerde T\u00dcFE burada tek ba\u015f\u0131na belirleyici kriter olmay\u0131p ba\u015fkaca unsurlarda de\u011ferlendirilmektedir.<\/p>\n<p>&nbsp;<\/p>\n<p>\u0130\u015f yeri kira art\u0131\u015f miktar\u0131 nas\u0131l belirlenecektir?<\/p>\n<p>\u0130\u015f yeri kira art\u0131\u015f miktar\u0131na ili\u015fkin yasal d\u00fczenlemeleri 01.07.2020 tarihi \u00f6ncesi ve sonras\u0131 olarak ay\u0131rmak do\u011fru olacakt\u0131r. \u015e\u00f6yle ki 6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&rsquo;nun ge\u00e7ici madde 2 d\u00fczenlemesi uyar\u0131nca 01.07.2020 tarihi \u00f6ncesinde i\u015f yeri kira art\u0131\u015f miktar\u0131 serbest\u00e7e kararla\u015ft\u0131r\u0131labiliyordu. Ancak 01.07.2020 itibariyle taraflar art\u0131k i\u015f yeri kira art\u0131\u015f oranlar\u0131nda da yukar\u0131da konut kira art\u0131\u015f oran\u0131nda anlatt\u0131\u011f\u0131m\u0131z d\u00fczenlemeye uymak zorundad\u0131rlar. Ba\u015fka bir deyi\u015fle i\u015f yeri kiralar\u0131nda da kira art\u0131\u015f oran\u0131 \u00f6nceki kira y\u0131l\u0131nda T\u00dcFE\u2019deki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7emeyecektir.<\/p>\n<p>&nbsp;<\/p>\n<p>Kira zamm\u0131n\u0131 y\u00fcksek bulan kirac\u0131 ne yapabilir? Fahi\u015f kira miktar\u0131n\u0131 \u00f6demek zorunda m\u0131d\u0131r?<\/p>\n<p>Kirac\u0131, yasal miktar\u0131n \u00fczerinde ger\u00e7ekle\u015fen kira zamm\u0131n\u0131 \u00f6demekle y\u00fck\u00fcml\u00fc de\u011fildir. Burada kirada yap\u0131lan art\u0131\u015f\u0131n fahi\u015f olup olmad\u0131\u011f\u0131 yasalara g\u00f6re de\u011ferlendirilir. Kirac\u0131 bu durumda T\u00dcFE oran\u0131na g\u00f6re kira bedelinde art\u0131r\u0131m yaparak \u00f6deyebilir yahut kiran\u0131n belirlenmesini hakimden talep edebilir. Kirac\u0131, kiran\u0131n y\u00fcksek oldu\u011fu iddias\u0131 ile dava a\u00e7t\u0131\u011f\u0131nda mahkeme T\u00dcFE oran\u0131, kiralanan\u0131n durumu ve emsal kira bedellerine g\u00f6re hakkaniyetli bir belirleme yapacakt\u0131r. Kira bedelinin belirlenmesine ili\u015fkin dava her zaman a\u00e7\u0131labilecektir.<\/p>\n<p>&nbsp;<\/p>\n<p>Kira miktar\u0131n\u0131 d\u00fc\u015f\u00fck bulan kiraya veren, kiran\u0131n belirlenmesi i\u00e7in dava a\u00e7abilir mi?<\/p>\n<p>Kiralayan ise kiran\u0131n d\u00fc\u015f\u00fck olmas\u0131 sebebiyle uygulamada kira uyarlama davas\u0131 olarak bilinen kiran\u0131n belirlenmesi davas\u0131n\u0131 her zaman a\u00e7abilecektir.<\/p>\n<p>Kirac\u0131n\u0131n da yasal kira art\u0131\u015f\u0131n\u0131 kabul etmeme gibi bir imk\u00e2n\u0131 yoktur. S\u00f6zle\u015fme olmas\u0131 halinde s\u00f6zle\u015fmeye, s\u00f6zle\u015fme olmamas\u0131 durumda da kanuna g\u00f6re yap\u0131lan art\u0131r\u0131m\u0131 kabul etmeli ve \u00f6demelidir. Usul\u00fcne g\u00f6re yap\u0131lan art\u0131r\u0131m\u0131 \u00f6demeyen kirac\u0131 yasal yollardan tahliye edilebilecektir.<\/p>\n<p>&nbsp;<\/p>\n<p>Kira zamm\u0131n\u0131 kabul etmeyen kirac\u0131 tahliye edilebilir mi?<\/p>\n<p>Uygulamada ta\u015f\u0131nmaz sahibi, fahi\u015f kiray\u0131 kabul etmeyen kirac\u0131y\u0131, ta\u015f\u0131nmazdan \u00e7\u0131karma tehdidi ile kar\u015f\u0131 kar\u015f\u0131ya b\u0131rakabilmektedir. Ancak yukar\u0131da detayland\u0131rd\u0131\u011f\u0131m\u0131z \u00fczere yap\u0131lmas\u0131 gereken<\/p>\n<p>kira art\u0131\u015f oran\u0131 T\u00fcrk Bor\u00e7lar Kanunu Madde 334\u2019de belirlenmi\u015ftir. \u0130lgili h\u00fck\u00fcm art\u0131k i\u015f yeri ve mesken ay\u0131rt edilmeksizin t\u00fcm kira s\u00f6zle\u015fmelerinde uygulanmaktad\u0131r. Kirac\u0131lar\u0131n kira bedellerini T\u00dcFE\u2019deki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131na g\u00f6re art\u0131\u015f uygulayarak \u00f6demesi kira ili\u015fkisinin devam\u0131 i\u00e7in yeterlidir. Bu sebeplerle kiraya veren taraf\u0131ndan talep edilen fahi\u015f kira bedelinin \u00f6denmemesi tahliye sebebi olamaz.<\/p>\n<p>&nbsp;<\/p>\n<p>Son olarak kira hukuku karma\u015f\u0131k ve detayl\u0131 bir konu olmas\u0131 dolay\u0131s\u0131yla hem kirac\u0131 olarak hem de kiralayan olarak ma\u011fdur olmaman\u0131z i\u00e7in avukat\u0131n\u0131za dan\u0131\u015fman\u0131z\u0131 \u00f6nerir sa\u011fl\u0131kl\u0131 ve huzurlu g\u00fcnler dileriz.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Av.
